Acceptance

If you visit or shop at NextWarehouse.com, you accept these terms and conditions. NextWarehouse.com will not accept any other terms and conditions of sale, unless Buyer and NextWarehouse.com have executed a master contract which specifically supersedes and replaces these terms and conditions.

Any term, condition, or proposals hereafter submitted by Buyer (whether oral or in writing) which is inconsistent with or in addition to the terms and conditions set forth hereon is objected to and is hereby rejected by NextWarehouse.com. NextWarehouse.com's silence or failure to respond to any such subsequent or different term, condition, or proposal shall not be deemed to be NextWarehouse.com's acceptance or approval thereof.

Shipping and Delivery

Due to sometimes delays may occur by banks and credit card companies during the billing process, orders PASSED BILLING by 12 pm PST will usually be shipped within 48 business hours if in stock, subject to product availability and verification of billing. You will be notified by email if there is any problem processing your order.

For items which are either oversized or need special handling (especially, residential addresses or location without loading facilities) there may be an additional fee. If there is an additional fee involved, we will contact you with the exact amount before releasing your orders.

Buyer shall promptly notify NextWarehouse.com, in no event later than five (5) business days after delivery, of any claimed shortages or rejection as to any delivery. Such notice shall be in writing and shall be reasonably detailed, stating the grounds for any such rejection. Failure to give any such notice within such time shall be deemed an acceptance in full of any such delivery. NextWarehouse.com shall not be liable for any shipment delays beyond the reasonable control of NextWarehouse.com which affect NextWarehouse.com, including but not limited to delays caused by unavailability or shortages of Products from NextWarehouse.com's suppliers; natural disasters, acts of war; acts or omissions of Buyer; fire, strike, riot, or governmental interference; unavailability or shortage of materials, labor, fuel, or power through normal commercial channels at customary and reasonable rates; failure or destruction of plant or equipment arising from any cause whatsoever; or transport failures .

Price and Payment

Buyer shall bear all applicable federal, state, municipal and other government taxes (such as sales, use, and similar taxes).

Exemption certificates must be presented prior to shipment if they are to be honored.

We accept major credit cards, including Visa, MasterCard, Discover, American Express and debit cards.

Government/ Education/ Company and Organization Purchase Orders are accepted, subject to account verification. All Purchase Orders less than US$500.00 are subject to US$5.00 surcharge.

Backorder Products

NextWarehouse makes every effort to honor the original purchase price for backorder products once the products arrive in stock. However, it is possible for manufacturers/ suppliers to change product prices and/ or for special promotions to end during the time following when a backorder was originally submitted. If the price for a backorder product increases from the time that the product was originally ordered to the time that the product arrives back in stock, NextWarehouse does reserve the right to raise the price of the backorder product for an existing order. Before raising the price of the product, NextWarehouse will contact the customer to explain this change before charging the customer for the product. The customer has the right and choice to either continue with the processing of the order at the updated price, or to cancel the order if not in agreement with the updated price.

Mispriced Product and Incorrect Information

With respect to all products sold at NextWarehouse.com, we always try to maintain the accuracy of price and information on all of our available products. However, in the event that there is an error that results in a mispriced product and/or incorrect information, NextWarehouse.com reserves the right to disclaim responsibility due to these errors.

As such, NextWarehouse.com shall have the right to refuse and cancel orders with incorrect prices and/or information. NextWarehouse.com will immediately notify customers of this matter if an order is placed with incorrect prices. NextWarehouse.com will notify the customer of any cancellation of orders, and if any payment was rendered, it will be returned in the same appropriate manner that the payment was made.

All items sold by NextWarehouse.com, Inc. are automatically covered by NextWarehouse.com's 30-day Guarantee against defects, except as otherwise specified on an individual basis on the invoice. Defect in this context means manufacturer's defects. We are not responsible for any damages resulting from work done by non-NextWarehouse.com certified technicians.
We do not guarantee compatibility.
NextWarehouse.com is not responsible for errors and shall have the right to refuse or cancel any orders placed for products listed with incorrect information.
Return of Products purchased hereunder shall be governed by NextWarehouse.com's Product Return policies as set forth herein on the date of the invoice, or as otherwise provided by NextWarehouse.com to Buyer in writing. NextWarehouse.com reserves the right to modify or eliminate such policies at any time. Although NextWarehouse.com's policies may permit Buyer to return Products claimed to be defective under certain circumstances, NextWarehouse.com makes no representation or warranties of any kind with respect to the Products. NextWarehouse.com HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, AS TO THE PRODUCTS, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. NextWarehouse.com WILL NOT BE LIABLE FOR ANY DAMAGE, LOSS, COST, OR EXPENSE FOR BREACH OF WARRANTY.

NextWarehouse.com's 30-Day Guarantee *** against defects shall constitute NextWarehouse.com's sole liability and Buyer's exclusive remedy in connection with any claim of any kind relating to the quality, condition, or performance of any Product, whether such claim is based upon principles of contract, warranty, negligence, or purpose or otherwise. In the event NextWarehouse.com issues a return authorization to Buyer allowing Buyer to return Product to NextWarehouse.com, Buyer will deliver the Product to NextWarehouse.com's address in the United States, if so required by NextWarehouse.com, and Buyer shall bear all applicable federal, state, municipal, and other government taxes (such as sales, use, and similar taxes) as well as import or customs duties, license fees, and similar charges, however designated or levied, on any replacement Product to be shipped by NextWarehouse.com to Buyer. This warranty applies to all products, unless specifically stated otherwise.

All products purchased at NextWarehouse.com is covered by NextWarehouse.com's 30-Day Against Manufacturer Defects Policy. The 30-Day Against Manufacturing Defects Policy covers factory defects that are caused by the manufacturer during the manufacturing process. The 30-Day Against Manufacturing Defect Policy commences from the original invoice date. Unless specifically stated in a separate policy, all requests to return a product MUST be made through NextWarehouse.com's technical and return department. All approved returns must be delivered to NextWarehouse.com's location or collection facilities within 30 days of the original invoice date, regardless of delays caused by natural calamities or human error. Any requests to return any product made beyond 30 days of the original invoice date will not be entertained and will have to be made through the product manufacturer, unless states otherwise.

All returns must be accompanied by a valid Return Merchandise Authorization (RMA) number issued by NextWarehouse.com's technical and return department. The RMA number is only valid for three (3) days for the date of issuance and the product must be shipped within these three (3) days. All returns MUST contain all of the original packaging intact and in unused condition. Any used or defaced products will void any claims for return. Shipping and Handling charges will not be refunded to customers, except specified on an individual invoice.

When RMA request has been approved, the customer will bear the responsibility for the freight charges and the risk of loss on all return shipments. All return shipments have to be made with carriers that offer tracking ability to help determine the chronological process of the return shipment.

Products that are marked with "Manufacturer Direct Warranty" are directly serviced by the manufacturer and are not covered by NextWarehouse.com's 30-Day Against Manufacturing Defects Policy. NextWarehouse.com does not claim responsibility for the warranty of these items and is not responsible to authorize any returns. These products are governed by the terms and conditions of the respective manufacturer. Please contact the manufacturer for further details.

All approved refund will be the current value or sale price of the returned product at NextWarehouse.com, which ever is lower, minus any applicable fee and/or charges.

Consumable Products

Consumable products including but not limited to ink toners, ink cartridges, fusers, batteries, and software (both physical and virtual software), cannot be returned after being opened and will be denied return upon request. "Opened" designation applies when any packaging, seals, stamps, etc. have been broken, opened, or tampered with. If you have questions, please contact us for support. If you are unsure whether the product which you are ordering is classified as a consumable product, please contact us before ordering for confirmation.

Consumable products are certified brand new and sealed when shipped from our warehouse, and carry any manufacturer's warranty which comes standard with the product(s) from the manufacturer directly. Please contact the manufacturer of the product directly for any warranty terms, stipulations, inquiries, and/ or claims.

Special Order Products

Special order products including but not limited to notebooks, workstations, tough books, servers, switches, storage arrays, uninterrupted power supplies, large format displays, cabinets, enclosures, monitors, etc., cannot be returned when needing to be built to order directly from the manufacturer. If you have questions, please contact us for support. If you are unsure whether the product which you are ordering is classified as a special order product, please contact us before ordering for confirmation.

Special order products are certified brand new and sealed when shipped from our warehouse, and carry any manufacturer's warranty which comes standard with the product(s) from the manufacturer directly. Please contact the manufacturer of the product directly for any warranty terms, stipulations, inquiries, and/ or claims.

The following rules apply according to the reason for return:
DO NOT WANT ITEM or ORDERED WRONG ITEM
Unopened box: A 7% restocking fee will be applied. Opened box: On most items, a 10% - 25% restocking fee will be charged, based upon the type of item and its condition.

SUSPECT ITEM IS DEFECTIVE
Defective item: A replacement will be sent to the customer in United States free of charge once we receive the defective item. Defective item will be replaced with the same model only. If the replacement is not available, we will give you full refund for the item, including S&H.

SHIPPING ERROR
Received Wrong Item or Wrong Quantity (must report within 3 business days): We understand how frustrating it is to receive the wrong item. Therefore, contact us immediately (within 48 hours) via our Customer Service and Return Department Online service, or call us at 1-877-235-6628. The correct item will be shipped to you immediately upon our receipt of the incorrect item.
Item Damaged in Transit (must report within 3 business days): If you receive a shipping carton that shows obvious damage, please refuse the shipment. The shipping carrier is responsible for these damages, not you. If, upon opening the carton, you discover that the product was damaged during shipment, contact the carrier for inspection. If your order was shipped via UPS and arrives damaged, save the original packing materials and call UPS (1 800 PICK UPS) to report the damage. Then please contact us via our Customer Service and Return Department Online service, or call us at 1-877-235-6628, and NextWarehouse.com will file a claim.

Limitation of Liability

NextWarehouse.com shall not be liable under any circumstances for any special consequential, incidental, punitive, or exemplary damages arising out of or in any way connected with the agreement to sell product to buyer or the product, including, but not limited to, damages for lost profits, loss of use, lost data, or for any damages or sums paid by buyer to third parties, even if NextWarehouse.com has been advised of possibility of such damages. The foregoing limitation of liability shall apply whether any claim is based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise.

Order Cancellation

If items have been sent to warehouse for fulfillment, cancellation not due to back order will be subject to cancellation fee, S/H will not be refundable.

General

All sales agreements shall be deemed made in, and shall be governed by, the laws of the State of California. The venue for any disputes arising out of any sales agreement shall be San Bernardino County, California. ALL SALES TRANSACTIONS EXCLUDE THE APPLICATION OF THE 1980 UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS, IF OTHERWISE APPLICABLE.
